Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and MOLDOPS LLC (“MoldOps,” “we,” “us”) governing your access to and use of the MoldOps web application at moldops.app and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a business, you represent that you are authorized to bind that business.
1. The Service
MoldOps is a subscription software platform that helps cultured marble and solid-surface shops manage quoting, production scheduling, shop-floor operations, inventory, deliveries, and accounting integration. We may add, change, or discontinue features over time.
2. Accounts
- You must provide accurate information and keep it up to date.
- You are responsible for keeping your login credentials confidential and for all activity under your account.
- You are responsible for the team members you invite and the roles you grant them.
- Notify us promptly of any unauthorized use of your account.
3. Subscriptions, trials, and billing
- Free trial. New accounts include a 14-day free trial. No charge is made during the trial, and you can cancel before it ends at no cost.
- Fees and renewal. Paid plans are billed in advance on a recurring monthly or annual basis through our payment processor, Stripe, and automatically renew until cancelled.
- Cancellation. You may cancel at any time from the billing page. Cancellation takes effect at the end of the current billing period; fees already paid are non-refundable except where required by law.
- Price changes. We may change subscription prices, with notice, effective at your next renewal.
- Taxes. Fees are exclusive of taxes, which you are responsible for where applicable.
4. Your data
As between you and MoldOps, you own the business data you enter into the Service (“Your Data”). You grant us a limited license to host, process, and transmit Your Data solely to provide and improve the Service. You are responsible for Your Data and for having the rights and any necessary consents to enter information about your own customers. Our handling of personal information is described in our Privacy Policy.
5. Third-party integrations
The Service can connect to third-party services, including QuickBooks Online (Intuit) and Stripe. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, and their availability or changes are outside our control. You authorize us to exchange data with a connected service to provide the features you enable, and you can disconnect at any time.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful or fraudulent purpose;
- Attempt to access accounts or data that are not yours, or to breach or circumvent security;
- Reverse engineer, copy, resell, or sublicense the Service except as permitted by law;
- Upload malicious code or interfere with the integrity or performance of the Service;
- Use the Service to send unlawful or unsolicited messages.
7. Intellectual property
The Service, including its software, design, and content (excluding Your Data), is owned by MoldOps and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription, subject to these Terms.
8. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free. MoldOps is a tool to help you run your shop; you remain responsible for your business decisions, pricing, and records.
9. Limitation of liability
To the fullest extent permitted by law, MoldOps will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data. Our total liability arising out of or relating to the Service will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim.
10. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. On termination, your right to use the Service ends; you may request an export of Your Data within a reasonable period before it is deleted in the ordinary course.
11. Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. The state and federal courts located in Miami-Dade County, Florida will have exclusive jurisdiction over any disputes, subject to any applicable arbitration or small-claims options.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.
